These Terms of Service ("Terms") govern your use of DNS-Proxy services. By using our services, you agree to these Terms. Please read them carefully.

1. Service Description

DNS-Proxy provides web security, DDoS protection, content delivery network (CDN), DNS services, and related infrastructure services ("Services"). We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

2. Account Registration and Eligibility

To use our Services, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of unauthorized account access
• Accept full responsibility for all activities under your account

3. Acceptable Use Policy

You agree NOT to use our Services to:

• Violate any laws, regulations, or third-party rights
• Distribute malware, viruses, or malicious code
• Host phishing sites, scams, or fraudulent content
• Engage in copyright infringement or intellectual property violations
• Send spam, unsolicited communications, or engage in email abuse
• Host adult content, hate speech, or illegal materials
• Conduct network scanning, penetration testing, or security research without authorization
• Resell or redistribute Services without a partnership agreement
• Interfere with or disrupt our infrastructure or other customers

Violations may result in immediate service suspension or termination without refund.

4. Payment Terms

4.1 Fees and Billing

• Fees are charged in advance on a monthly or annual basis
• All fees are non-refundable except as required by law or our 30-day money-back guarantee
• Prices may change with 30 days' notice to existing customers
• Failure to pay may result in service suspension or termination

4.2 Taxes

You are responsible for all applicable taxes, duties, and government fees. Prices do not include VAT, GST, or sales tax unless explicitly stated.

4.3 Refunds

We offer a 30-day money-back guarantee for new customers on monthly or annual plans. Refund requests must be submitted within 30 days of initial payment. Overage charges, add-ons, and domain registrations are non-refundable.

5. Service Level Agreement (SLA)

We commit to the following uptime targets:

• Starter Plan: 99.9% monthly uptime
• Pro Plan: 99.95% monthly uptime
• Enterprise Plan: 99.99% monthly uptime with custom SLA options

Downtime credits are calculated as a percentage of monthly fees based on actual downtime exceeding SLA thresholds. Scheduled maintenance and circumstances beyond our control are excluded.

6. Data and Privacy

Our collection and use of your data is governed by our Privacy Policy. You retain ownership of your content and data. You grant us a limited license to process, store, and transmit your data solely to provide the Services.

7. Intellectual Property

All intellectual property rights in the Services, including software, documentation, trademarks, and logos, remain our exclusive property. You may not copy, modify, reverse engineer, or create derivative works without written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability for any claims is limited to fees paid in the 12 months preceding the claim
• We are not liable for indirect, incidental, consequential, or punitive damages
• We do not guarantee uninterrupted or error-free service
• Services are provided "AS IS" without warranties of any kind

9. Indemnification

You agree to indemnify and hold harmless DNS-Proxy, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms or applicable laws
• Your content or materials transmitted through our Services
• Your infringement of third-party rights

10. Termination

10.1 By You

You may terminate your account at any time through your dashboard or by contacting support. Termination does not entitle you to refunds for unused service periods.

10.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay fees when due
• Engage in fraudulent or illegal activities
• Pose a security risk to our infrastructure or other customers

10.3 Effect of Termination

Upon termination, your access to Services will cease. We will retain your data for 90 days to allow retrieval, after which it will be permanently deleted unless legally required to retain it longer.

11. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use of Services after changes constitutes acceptance. If you disagree, you may terminate your account.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

12.2 Arbitration

Except for small claims court matters, disputes will be resolved through binding arbitration under the American Arbitration Association (AAA) rules. You waive the right to participate in class actions.

12.3 Jurisdiction

For matters not subject to arbitration, you consent to exclusive jurisdiction in state and federal courts located in San Francisco County, California.

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement and supersede all prior agreements
• Severability: Invalid provisions will be modified to be enforceable; remaining Terms stay in effect
• Waiver: Failure to enforce any provision does not waive our right to enforce it later
• Assignment: You may not assign these Terms; we may assign to affiliates or successors
• Force Majeure: We are not liable for delays caused by events beyond reasonable control
